Why the Jury is Just Not Getting It
APVisuals has been providing trial support, graphic design, and trial exhibits to South Florida lawyers for over 15 years. During this time, we have seen all sorts of jurors. Jurors that take notes, jurors that fall asleep, jurors that decide before any evidence is presented, jurors that make their decision based on how they feel about the attorneys, jurors that listen, and even jurors that struggled with reading their oath. However, I think one thing that the majority of trial lawyers would agree to is that the jury system works - not because it is perfect but because it is imperfect. If the system did not work, then attorneys would be requesting bench trials rather than jury trials. In addition, juries are the most DEMOCRATIC aspect of our constitution. Citizens making decisions on a daily basis about fellow citizen's issues, crimes, and conflicts - not just going to vote every 2 to 4 years.
The problem with presenting your case to the jury is the same reason why it makes it great, the variety of people and learners that you get. The goal is to capture your jury's attention and keep it. In today's society visual stimuli is a constant. People are used to having their portable electronic devices almost glued to their hands 24 hours a day. They are used to seeing unrealistic courtroom television shows that - you know and I know - show procedures that would never take place and evidence that would never come in. However, the unrealistic expectations on the jury's part exists. How do you fix that? - MAKE SURE YOU HAVE GREAT VISUALS.
