Mediation Settlement Strategy


Are you moving toward mediation in your case - either pre-suit or right before trial? What do you have up your sleeve? If anything. the reality is that most defendants and most insurance adjusters have seen it all. They are simply going through the motions at mediation. More likely than not, the adjuster has read the pre-trial report, the deposition reports and the interim reports from the attorney, but the adjuster has not: 1) read the depositions themselves; 2) looked at the medical records himself; 3) reviewed the films themselves. In most cases, the adjuster is relying on the information provided by the insurance defense counsel. Accordingly, if they have the portrayed the case in a light by making it more favorable to the defense, you will not likely see much offered in mediation. In addition, the value that they have given your case is much lower than you have given your case , because they do not have the entire picture.

Having a clear and convincing mediation settlement presentations is key. Showing the adjuster that are you not only ready to go to trial the next day because all of your ducks are in a row, but incorporate key information that the insurance defense attorney has not provided to the adjuster. I know it may be hard to believe but ... adjusters are people to. It would be wise to incorporate a day in the life video into your mediation presentation to get to the adjuster's humanity. Make the adjuster understand that the injuries is not just a number that you punch into your computer program to calculate the potential value of the case.
